The 76-kilogram dog which mauled a 10-year-old girl and threw her around "like a rag doll" in a terrifying backyard attack in Melbourne's south-east has been destroyed.

The girl sustained extensive injuries "from the ears down" in the attack and remains in a stable condition at the Royal Children's Hospital.

The City of Casey on Monday confirmed its officers had been called to the property in Berwick in December 2017 and had issued four infringements to the dog owner in the past two months.

Officers were first called to the property in December following reports that a dog, described as similar to a Bullmastiff, had acted aggressively towards a female jogger.

"Following an investigation, it was deemed the incident was not serious enough to trigger seizure of the dog," the council said in a statement.

Officers issued four fines to the dog owner in January and February, relating to an animal biting a person, allowing a dog to be "at large" at night, and failing to register two dogs.

The male dog believed to be responsible for the attack on the 10-year-old is a South African boerboel, the council said.

Male breeds of the dog can weigh up to 90 kilograms once they are fully grown.

The second dog, which had also been seized, is a bull mastiff.

Neither of the dogs was registered with the City of Casey, the council said.

On Monday, the council requested that the owner authorise that the dog responsible for the attack was destroyed.

The council confirmed just before 4.30pm that the dog had been euthanised with the owner's consent.

Neighbours rushed to the home after hearing screaming and seeing the girl's sister, 7, calling for help about 8pm on Sunday night.

The girls' mother had left them home alone while she went to the gym, neighbours said.

Jimmy Baird, one of a group who rushed to the girls' aid, said he was confronted by a "massive" dog, "going berserk".

He said he feared for his own safety as he and other neighbours tried to distract the frenzied dog to rescue the girl.

"I opened the door and just saw this big frothing head coming through the door," he told radio station 3AW.

"I managed to get door closed again but the girl was still out there.

"We couldn't get her out because [the dog] was just going berserk. It was just massive. It was shaking the whole window frame".

The animal was one of two dogs in the backyard. Only one is reported to have attacked.

Neighbours worked together to distract the dog while the girl was retrieved from the backyard.

But Mr Baird said she'd been badly mauled.

"The poor girl was in a bad way," he said, with bite marks "from her ears down".

The girl's sister described her sibling being thrown around the backyard "like a rag doll," Mr Baird said.

He said she was covered with blood and dirt and her injuries were so extensive, the neighbours had difficulty carrying her.

"We didn’t realise how bad it was until they started cutting her clothes off,” he said.

A neighbour drove the younger sister to several gyms in the area in an unsuccessful attempt to locate the girls' mother following the attack.

Kerrie Baird said the mother and a male friend arrived home about an hour later.

Mr Baird said he was glad he and the other neighbours had been home because the dog "obviously wasn't going to stop, you know".

He told 3AW he had heard the family's two dogs at the property but had never seen them.

"I don't want to see them again either," he said.

Another neighbour, who didn’t want to be named, said he often heard the dog - which he described as very large - barking, but said it lived inside and he had never seen it taken for walks.

The attack comes just days after the death of a one-year-old girl, killed by her family's dog in northern New South Wales.

The baby died on the way to hospital after being attacked by the family's Rottweiler.

Senior lecturer in Animal Behaviour and Veterinary science at the University of Adelaide, Doctor Susan Hazel, said there was no single reason why dogs attack people.

"It may be because they are scared of something, or that their predator drive kicks in, or that the dog was playing and did not mean to bite," she said.

"If something is bothering a dog, an attack is usually the last resort for the dog and they will try other things first to dampen down the situation."

Dr Hazel said while there was no single intervention that could prevent all attacks, education played a critical role in minimising risk.

"Education programs for young children and parents are important as young children are at higher risk of an attack," she said.

"Appropriate socialisation and training of dogs is critically important. A lot of people don’t know how to recognise signs that a dog is stressed and may bite. Local councils do a lot of work in managing animals and regulations can help [including] managing dangerous dogs that have already attacked."

狗兒咬人，飼主該負哪些法律責任？一般來說所應負的法律責任有三種：
一、『行政罰』部分：
政府於民國87年的11月4日公布了「動物保護法」，明定要給予動物適當的保護，也訂有防止動物侵害他人權益的規定。違者可處以罰鍰。動物保護法第20條第2項規定：「具攻擊性之寵物出入公共場所或公眾得出入之場所，應由成年人伴同，並採取適當防護措施。」
所謂「防護措施」，依行政院農業委員會的公告，是指「23公斤以上的犬隻，出入公共場所或公眾得出入之場所，應由成年人伴同，及以長度不超過1.5公尺之鍊繩牽引作為防護措施。具有攻擊性品種或有攻擊紀錄之犬隻，出入公共場所或公眾得出入之場所，除應由成年人伴同，及以長度不超過1.5公尺之鍊繩牽引外，應戴口罩。」違反第2項規定拒不改善，還可以逐次處罰。要處罰新台幣30000元以上150000元以下罰鍰。
二、『刑事責任』
刑法第284條第1項、寵物傷害到他人的身體健康，飼主應注意而沒有注意，故顯然有過失，要負起過失傷害罪的刑責。
三、『民事責任』
民法第190條第1項規定：「動物加損害於他人者，尤其占有人（飼主）負損害賠償責任。」被害人得要求飼主賠償醫藥費。


刑法第277條

傷害人之身體或健康者，處三年以下有期徒刑、拘役或一千元以下罰金。犯前項之罪因而致人於死者，處無期徒刑或七年以上有期徒刑；致重傷者，處三年以上十年以下有期徒刑。

社會秩序維護法第70條

有左列各款行為之一者，處三日以下拘留或新臺幣一萬二千元以下罰鍰：
一、畜養危險動物，影響鄰居安全者。
二、畜養之危險動物，出入有人所在之道路、建築物或其他場所者。
三、驅使或縱容動物嚇人者。

道路交通安全規則
第 88 條

機車附載人員或物品，應依下列規定：
一、載物者，小型輕型不得超過二十公斤，普通輕型不得超過五十公斤， 重型不得超過八十公斤，高度不得超過駕駛人肩部，寬度不得超過把 手外緣十公分，長度自座位後部起不得向前超伸，伸出車尾部分，自 後輪軸起不得超過半公尺。
二、小型輕型機車不得附載人員，重型及普通輕型機車在駕駛人後設有固 定座位者，得附載一人。
三、附載坐人後，不得另載物品。但零星物品不影響駕駛人及附載人員之 安全者，不在此限。
四、附載坐人不得側坐。
五、駕駛人及附載坐人均應戴安全帽。
六、裝載容易滲漏、飛散、氣味惡臭之貨物，能防止其發洩者，應嚴密封 固，裝置適當。
七、附載坐人、載運貨物必須穩妥，物品應捆紮牢固，堆放平穩。
機車駕駛人及附載座人應依下列規定配戴安全帽：
一、安全帽應為乘坐機車用之安全帽，經經濟部標準檢驗局檢驗合格，並 於帽體貼有商品檢驗標識。
二、帽體及相關配件必須齊全，並無毀損、鬆脫或變更之情事。
三、配帶時安全帽應正面朝前及位置正確，於顎下繫緊扣環，安全帽並應 適合頭形，穩固戴在頭上，不致上下左右晃動，且不可遮蔽視線。

道路交通管理處罰條例第31條第5項規定：「機器腳踏車附載人員或物品未依規定者，處駕駛人新臺幣300元以上600元以下罰鍰。」另按道路交通安全規則第88條規定：普通重型機車及普通輕型機車在駕駛人後設有固定座位者，得附載1人，附載坐人時應穩妥、不得側坐並應配戴安全帽。因此，如附載之兒童未戴安全帽，還要另外處罰新臺幣500元。

狂犬病


病原體
狂犬病是一種急性由狂犬過濾性病毒引起的中樞神經系統傳染病，可影響哺乳類動物，例如狗、貓、狐類、蝙蝠和人類。
傳播途徑
當人類被帶病毒動物咬傷或抓傷，或傷口被舐後，動物唾液內的病毒經傷口侵入人體，沿神經直到腦部，造成腦炎。狂犬病也可以通過吸入含病毒的水點或通過移植受感染的器官傳播，但相當罕見。
潛伏期
潛伏期通常是 1 至 3 個月，但亦有可能是 1 星期以內至超過 1 年。
病徵
狂犬病初期的病徵並不特別，與流感病徵相似，包括疲倦、發燒或頭痛，可能持續數天，受傷部位附近可能麻痺或刺痛。數天後患者會出現焦慮、神志不清、咽喉肌肉痙攣、癱瘓、昏迷和死亡。
治理方法
當病徵出現後，狂犬病一般會致命，醫生會對患者施以支援性治療。

預防方法



  1. 狗主必須替其狗隻領取牌照及替家畜作預防狂犬病注射。
  2. 避免與不明來歷的動物接觸，包括狗、貓、猴子等。
  3. 傷前或傷後接種預防疫苗和徹底清洗傷口是最有效的預防方法。被動物咬傷後，盡速用清水及肥皂清洗傷口，然後前往附近的急症室接受治療。如有需要，醫生會為傷者提供傷後疫苗注射。
  4. 傷前接種預防疫苗宜用於要長期逗留疫區的旅客，特別是要去偏遠和缺乏醫療設施的鄉村地方，或者在疫區逗留雖然很短時間，但要進行高危活動 （長途步行、踩單車、遠行、處理動物）的旅客。如要獲得更多資訊，請瀏覽衞生署旅遊健康服務網頁。
